Discretionary Fiscal Policies over the Cycle: New Evidence Based on the ESCB Disaggregated Approach

This paper explores how discretionary fiscal policies on the revenue side of the government budget have reacted to economic fluctuations in European Union countries. For this purpose, it uses data on legislated revenue changes and structural indicators provided twice per year by National Central Banks of European Union countries in the ESCB framework for analysing fiscal policy. The analysis is based on the estimation of fiscal policy rules linking these measures of legislated fiscal policy changes to the output gap and other control variables. La mobilità volontaria nel Pubblico Impiego: margini di discrezionalità dell'Amministrazione di destinazione

Il contributo, a partire da una recente pronuncia del Tribunale di Catanzaro, affronta la questione dei margini di discrezionalità della pubblica amministrazione reclutante nei procedimenti di mobilità individuale volontaria ex art. 30 d.lgs. n. 165/2001, con specifico riferimento alla fase di valutazione delle competenze professionali dei candidati. Ciò offre l’occasione per soffermarsi sulla natura dell’istituto, anche alla luce dei più recenti approdi legislativi in materia.

Starting from a recent decision of the Tribunal of Catanzaro the contribution examines the question of the discretionary margins of the recruiting public administration in individual voluntary mobility procedures pursuant to article 30 paragraph 1 legislative decree no. 165/2001. Specifically it deals with the phase of evaluation of the candidates’ professional skills. This paper aims the administrative judge’s powers of inquiry in the administrative act in the light of art. 21-octies of l. n. 241/1990 and art. 31 and 34 of the Administrative Process Code, and also in the light of administrative jurisprudence. The purpose is to verify if these rules represent a limit to the Supreme Court’s thesis, about a new line of division between the jurisdictions’ areas of interest based not on the existence of public power, but on its discretionary nature.
